With time, most people will recover from the breakdown of their relationship; however, they will have to live the rest of their lives with financial decisions they made while under great emotional stress.
Financial issues of divorce:
How do we divide the income and assets meant to provide for one family so that they will meet the needs of two families post divorce?
What are the guidelines for child support and or alimony?
Are the assets classified as marital property (meaning accumulated/earned by either spouse since the beginning of the marriage); or, separate property (1. Property brought into the marriage, 2. An inheritance, 3. Gifts received during the marriage.) What rights do the other spouse have to separate property?
Retirement funds. Different criteria should be used to analyze the value and division and the ensuing tax liabilities of certain types of retirement assets.
Is there a family owned business involved? What is the value? What is an equitable division?
Potential Income tax liabilities. While the division of marital property does not create a tax situation, selling an asset in the future may trigger an income tax liability to the receiving spouse.
